Information about the protection of Guests' personal data at “LIBURNIA HOTEL & SPA” LIMITED LIABILITY COMPANY
1. The Personal Data Administrator of the Guest is “LIBURNIA HOTEL & SPA” LIMITED LIABILITY COMPANY, headquartered in Cieszyn at ul. Liburnia 10, 43-400 Cieszyn, KRS 0000467097, NIP: 5482663427, REGON: 243294795 (hereinafter referred to as the "Hotel"). Contact details for the Personal Data Administrator are as follows:

2. The Administrator has not appointed a Data Protection Officer.
3. The Guest's personal data provided at the time of booking is processed based on the contract concluded between the Guest and the Hotel for the provision of hotel services. The purpose of processing personal data is to provide hotel or similar services that at the Guest's request are provided by the Hotel. For this purpose, the processing of personal data is based on Article 6(1)(b) of GDPR. Failure to provide personal data makes it impossible to conclude a contract with the Hotel and also prevents issuing a VAT invoice.
4. The Guest's personal data is processed by video monitoring to protect the Guest and other persons present on the Hotel premises or in its vicinity. The processing of personal data for this purpose is based on Article 6(1)(f) of GDPR – the justified interest of the Hotel. The Hotel has assessed the impact of actions taken for this purpose on the Guest's privacy. This assessment led the Hotel to the conclusion that the processing of personal data through monitoring improves the quality and safety of the services provided by the Hotel, which benefits the Guest by increasing their security. The Guest's interests and privacy will not be violated.
5. In case the Guest provides personal data regarding preferences related to the stay or services rendered, the Hotel may process this personal data to improve the quality of Hotel services or to provide comfort to the Guest or to carry out additional services for the Guest. This also applies to the processing of sensitive data. The legal basis for processing personal data for this purpose is the justified interest of the Hotel (Article 6(1)(f) GDPR). The Hotel has assessed the impact of such measures on the Guest's privacy. The assessment led the Hotel to conclude that processing personal data under the justified interest does not infringe on the Guest's privacy, and such processing aims to improve the quality of services provided by the Hotel, which benefits the Guest by better understanding their needs. Therefore, the Guest's interests and privacy will not be violated.
6. Personal data may also be processed to conduct Guest satisfaction surveys related to the services provided by the Hotel. The legal basis for processing personal data for this purpose is the justified interest of the Hotel (Article 6(1)(f) GDPR). The Hotel has assessed the impact of these activities on the Guest's privacy. The assessment led the Hotel to the conclusion that processing personal data under the justified interest does not infringe on the Guest's privacy, as such processing aims to improve the quality of services provided by the Hotel, which benefits the Guest by better understanding the Guest's needs. Therefore, the Guest's interests and privacy will not be violated.
7. The Hotel informs that each Guest has the right to access their personal data and to correct, update, or delete them. Each Guest also has the right to data portability, to restrict processing, to object to processing, and to delete personal data, although the possibility (scope and circumstances) of exercising these rights depends on meeting the conditions specified by the law. The data subject has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that the processing of their personal data violates GDPR provisions.
8. The Hotel informs that the Guest's personal data will be stored throughout the period of providing hotel services to the Guest, as well as data will be stored for the limitation period of any claims, including tax and civil claims. However, personal data processed by video monitoring will be stored for 30 days, unless due to special circumstances (e.g., accident) the monitoring record must be stored longer, including during potential proceedings conducted under the provisions of the law.
9. The Hotel informs that the Guest's personal data may be disclosed, to the necessary extent, to the following categories of recipients:
- entities providing accounting services cooperating with the Hotel,
- law firms cooperating with the Hotel,
- entities providing insurance services cooperating with the Hotel,
- entities providing IT services and entities supporting and managing the Hotel's IT infrastructure,
- entities providing courier and postal services.
10. The Hotel informs about the right to lodge a complaint to the supervisory authority overseeing the manner of personal data processing.
11. When booking accommodation at the Hotel through a travel agency or booking portal, the Guest's personal data transferred to the Hotel by these entities may include the Guest's name and surname, date of stay, email address, and phone number. Information about the exact source from which the Hotel obtained the Guest's personal data can be obtained at the reception.
12. Personal data collected by the Hotel may be subject to automatic profiling to match products to the Guest's needs. This is necessary to provide discounts.
